With reference to your letter of 6th December, 1937 No: 53858/37, transmitting a copy of a despatch from the Officer Administering the Government of Hong Kong forwarding for approval the draft of a Bill to amend the Defence Contribution Ordinance No: 1 of 1901, I am commanded by the Army Council to state for the information of Mr. Secretary Ormsby Gore that they have no objection in principle to approval being given to the draft Bill being introduced in the Legislative Council.
I am, however, to suggest that for the words
"all revenue refunds" proposed for the new clause at the end of sub-section (2) of Section 3 of the Ordinance should be substituted the wording in the memorandum enclosed with Colonial Office circular of 15th January, 1937, viz :-
"(XII)
revenue refunds, i.e.
(a) duty or tax levied by Ordinance which was in
the first instance correctly collected but has been reclaimed under conditions laid down in the Ordinance and
(b) duty, tax or other receipts collected in
error in years previous to that in which they are repaid.
